GENERAL TERMS AND CONDITIONS OF SALE
1. SCOPE OF APPLICATION
These General Terms and Conditions of Sale (“Terms”) govern the relationship between Kitsune Trading Sagl and its customers in connection with purchases made through the website www.kitsunetrading.ch.
By placing an order on the Website, the Customer confirms that they have read and accepted these Terms.
Any specific terms expressly agreed in writing with professional or commercial customers shall prevail over these Terms in the event of any conflict.
These Terms apply in the version in force at the time the order is placed.
2. SALE OF ALCOHOLIC BEVERAGES
THE SALE OF ALCOHOLIC BEVERAGES IS STRICTLY LIMITED TO PERSONS AGED 18 OR OVER.
By placing an order containing alcoholic beverages, the Customer confirms that they are at least 18 years old and legally entitled to purchase and consume the beverages ordered.
Kitsune Trading Sagl reserves the right to verify the age of the purchaser and, where necessary, to request proof of identity.
Delivery of alcoholic beverages may be refused if compliance with the applicable age requirements cannot be verified.
Kitsune Trading Sagl also reserves the right to cancel orders where there are reasonable grounds to doubt that the age requirements have been met.
We recommend the responsible and moderate consumption of alcoholic beverages.
3. ORDERS AND CONCLUSION OF THE CONTRACT
The products presented on the Website are described in the relevant product pages and are available subject to stock availability.
Before final confirmation of the order, the Customer has the opportunity to review and correct the information entered, the selected products, quantities, billing and delivery addresses and the total price of the order.
By submitting the order through the final purchase button, the Customer places a binding order for the selected products.
The contract is deemed concluded when Kitsune Trading Sagl sends the order confirmation to the email address provided by the Customer.
The Customer will also receive by email the main information relating to the order and, where applicable, the corresponding invoice.
Once the order has been confirmed, the possibility of modifying or cancelling it is not guaranteed. If the Customer notices an error, they are invited to contact us as soon as possible at info@kitsunetrading.ch.
Kitsune Trading Sagl reserves the right to cancel an order in whole or in part in the event of subsequent product unavailability, an obvious error in the price or product characteristics, technical problems or other circumstances making fulfilment of the order impossible. In such cases, any amounts already paid for products that cannot be supplied will be refunded.
To process an order, the following information may be required, depending on the circumstances: first and last name, billing address, delivery address, email address, telephone number and information necessary for payment processing.
The processing of personal data is governed by our Privacy Policy.
4. PRICES, VAT AND DELIVERY COSTS
All prices published on the Website are stated in Swiss francs (CHF) and, unless otherwise indicated, include the applicable VAT.
VAT rates are applied in accordance with current Swiss legislation.
The current standard VAT rate is 8.1%, applicable among other things to alcoholic beverages and various other products and accessories, while the reduced rate of 2.6% applies to products falling within the categories provided for by law, such as certain food products and tea.
Prices and offers may be changed at any time. Any changes will not affect orders that have already been concluded.
Offers and product availability remain valid while they are published on the Website and while stocks last.
We currently ship orders placed through our online store to Switzerland and Liechtenstein.
Shipping costs are not included in the product prices and are displayed separately before final confirmation of the order.
Unless otherwise stated or subject to a promotion, the following conditions generally apply to standard deliveries:

orders under CHF 150.– and weighing less than 30 kg: CHF 15.–;

orders of CHF 150.– or more: free shipping.
Any special terms, surcharges or costs relating to exceptional shipments will be indicated before the order is concluded or agreed with the Customer.
5. PAYMENT METHODS
Payments made through www.kitsunetrading.ch are processed using secure payment systems.
Available payment methods may vary over time and are displayed to the Customer during the checkout process.
Depending on availability, payment methods may include credit and debit cards, digital wallets, electronic payment services and advance bank transfer.
For payments by card or electronic payment services, the charge is made in accordance with the terms of the selected payment method.
In the case of advance payment by bank transfer, the bank details and payment instructions are provided during the ordering process or in the relevant confirmation.
Unless otherwise indicated, payment by bank transfer must be made within 10 days of the order date. The order will be shipped once payment has been received.
Payment is considered completed once Kitsune Trading Sagl has access to the amount due.
In the event of overdue and unpaid amounts, Kitsune Trading Sagl may charge default interest in accordance with applicable Swiss law and, where applicable, request reimbursement of legitimately incurred debt collection costs.

6. DELIVERY AND SHIPPING
Orders are prepared with care using packaging suitable for the transport of bottles and other products.
Provided the goods are in stock, delivery normally takes place within approximately 5 business days.
The stated delivery times are indicative and may vary, in particular during public holidays, periods of high order volume, adverse weather conditions or due to circumstances attributable to the carrier.
In the event of product unavailability or significant delays, Kitsune Trading Sagl will inform the Customer as soon as reasonably possible.
A delivery address different from the billing address may be entered during the ordering process.
Shipments are generally entrusted to Planzer AG and, depending on requirements, may also be carried out by Swiss Post Ltd, DHL, DPD or other professional carriers.
The Customer is responsible for providing a complete and accurate delivery address and, where requested, a telephone number through which they may be contacted in connection with the delivery.
Upon receipt, the Customer is invited to inspect the external condition of the packaging.
In the event of obvious damage, such as severely damaged packaging, broken bottles or liquid leakage, the Customer is invited, where possible, to report the issue immediately to the carrier and to contact Kitsune Trading Sagl.
Where the Customer has authorised delivery without a signature or to a location expressly designated by them, Kitsune Trading Sagl cannot be held responsible for loss or damage occurring after correct delivery to the designated location.
7. COMPLAINTS, DEFECTIVE PRODUCTS AND WARRANTY
For any problems, complaints, damaged, incorrect or non-conforming products, the Customer is invited to contact Kitsune Trading Sagl at:

In the event of visible damage at the time of delivery, such as broken bottles, severely damaged packaging, leaks or incorrect products, we ask the Customer to notify us preferably within 24 hours of receipt, providing, where possible, photographs of the packaging, shipping label and affected products.
The 24-hour period is intended to allow us to deal promptly with the carrier and does not affect any warranty rights provided by law.
For defects that are not immediately apparent at the time of delivery, the Customer must notify us promptly after discovering the defect.
For new products sold to consumers, the warranty limitation period provided under Swiss law applies, namely two years from delivery, subject to the requirement to notify defects promptly.
Where products are recognised as defective, damaged, incorrect or non-conforming, Kitsune Trading Sagl will assess, depending on the nature of the issue and in accordance with applicable law, whether to replace the product, reduce the price, issue a refund or offer another appropriate solution.
Before returning any product, the Customer must contact Kitsune Trading Sagl and wait for the relevant instructions.
If a return is required, the return address and instructions will be provided by email.
Where products are recognised as defective, incorrect or damaged for reasons attributable to Kitsune Trading Sagl or to the transport process, the return procedure and related costs will be agreed with the Customer.
Warranty exclusions
Alterations or damage resulting from the following are not considered defects attributable to Kitsune Trading Sagl:

incorrect storage after delivery;

exposure of the product to unsuitable temperatures, light or environmental conditions;
-
improper use or handling;
-
opening, contamination or damage to the product attributable to the Customer;
-
failure to follow any storage instructions indicated on the label or communicated by Kitsune Trading Sagl.
As our products consist mainly of beverages and food products, certain organoleptic characteristics may vary naturally between productions, vintages or batches. A personal preference regarding the taste, aroma, colour or style of a product does not in itself constitute a defect where the product conforms to its description, has been properly stored and shows no abnormalities.
8. CHANGE OF MIND, ORDERING ERRORS AND VOLUNTARY RETURNS
Swiss law does not provide for a general right of withdrawal or return for a simple change of mind in online purchases.
Unless otherwise agreed in writing with Kitsune Trading Sagl, we therefore do not accept returns or refund requests resulting from a change of mind, an ordering error or the Customer’s personal preferences.
In particular, for reasons of safety, traceability and proper storage, food products and beverages cannot be returned if they have been:

opened;
-
used or partially consumed;
-
tampered with;
-
damaged after delivery;
-
stored under unsuitable conditions.
Any exceptions may be considered solely by Kitsune Trading Sagl and must be agreed in writing in advance.
If Kitsune Trading Sagl voluntarily accepts a return that does not result from a defect, damage or error attributable to the seller, the return shipping costs are borne by the Customer.
A refund in the form of a store credit or gift card may be agreed with the Customer in connection with voluntarily accepted returns.
For authorised returns with a value exceeding CHF 100.–, we recommend using a tracked and insured shipping service.
9. LIABILITY
Kitsune Trading Sagl is liable for damage to the extent provided by applicable law.
To the extent permitted by law, liability is excluded for damage resulting from improper use of the products, inadequate storage after delivery or failure to follow the instructions provided.
Product images shown on the Website are for illustrative purposes only. Graphic changes to labels, packaging or product presentation made by the manufacturers that do not alter the essential characteristics of the product do not constitute a defect.
10. CHANGES TO THE GENERAL TERMS AND CONDITIONS
Kitsune Trading Sagl reserves the right to amend these General Terms and Conditions of Sale at any time.
The new terms will enter into force upon publication on the Website and will apply to orders placed after such publication.
Orders already concluded will remain subject to the terms in force at the time the order was placed.

12. APPLICABLE LAW AND JURISDICTION
These General Terms and Conditions of Sale and the contracts concluded through www.kitsunetrading.ch are governed by Swiss law.
For contracts concluded with consumers, the competent courts provided for by the mandatory provisions of Swiss law shall apply. The consumer’s rights relating to jurisdiction are not restricted by these General Terms and Conditions.
For relationships with commercial or professional customers, subject to mandatory legal provisions or any written agreement to the contrary, the competent court shall be the court at the registered office of Kitsune Trading Sagl.
